Terms & Conditions, Funka Accessibility Score

These Terms & Conditions (“Terms”) apply when you use the Funka Accessibility Score, including free scans, reports, monitoring, badges, public accessibility pages, the Funka Barometer and any related Free or Premium features (“the Service”).
The Service is provided by Funka International AB (“Funka”, “we”, “us”).
By submitting a website URL for measurement, creating an account or otherwise using the Service, you agree to these Terms.
The Funka Accessibility Score
The Funka Accessibility Score is designed to provide an indication of the current accessibility of a website and help organisations understand, monitor and improve their digital accessibility.
The Score is produced using Funka’s automated scanning technology against applicable accessibility criteria, including criteria derived from WCAG, together with additional factors and methodology developed from Funka’s accessibility expertise.
Depending on your plan, the Service may include an Accessibility Score, accessibility report, identified issues, improvement recommendations, monitoring, Accessibility Statement tools, AI-powered insights, badges and a public accessibility page.
The methodology, criteria, weighting and technology used to calculate the Score may be updated over time as accessibility standards, technology and Funka’s methodology evolve.
The Score is indicative
The Funka Accessibility Score is indicative. It is not a complete accessibility audit, certification, legal compliance assessment or guarantee that a website is accessible or compliant with applicable legislation.
Automated testing can detect only a portion of accessibility and usability barriers.
Some accessibility requirements depend on human judgement or user experience and cannot be reliably assessed through automated testing alone. These can include, for example, the meaningfulness of alternative text, logical reading and focus order, clear language, keyboard interaction and the usability of complex components.
For this reason:
- A high Accessibility Score does not guarantee that a website is fully accessible or legally compliant.
- A low Accessibility Score does not necessarily mean that a website is unusable or non-compliant.
- The Score should not be relied upon as the sole assessment of a website’s accessibility.
For a comprehensive assessment of accessibility or legal compliance, automated testing should be complemented by appropriate manual expert review, assistive technology testing and, where relevant, testing with people with disabilities.
Funka provides separate expert audit and assessment services for organisations requiring a more comprehensive evaluation.
No certification or legal advice
Unless Funka has expressly provided a separate formal assessment or certification service in writing, the Funka Accessibility Score, report, badge, Accessibility Statement tools and related outputs do not constitute:
- a certification of accessibility;
- confirmation of legal compliance;
- legal advice;
- a formal accessibility audit; or
- an approval or endorsement by Funka.
The Service should not be treated as proof of compliance with the European Accessibility Act, Web Accessibility Directive, EN 301 549, WCAG, the ADA or any other law, regulation or accessibility standard.
Responsibility for ensuring that a website and its services comply with applicable accessibility requirements remains with the organisation responsible for that website.
Free scans and the Funka Barometer
When you submit a publicly accessible website URL for a free Funka Accessibility Score, that website may automatically be included in the Funka Barometer.
The Funka Barometer is Funka’s benchmarking initiative for measuring and comparing digital accessibility across organisations, sectors and markets.
By submitting a URL for a scan, you acknowledge and agree that Funka may:
- retain the website URL and results generated from the scan;
- include the website and its results in the Funka Barometer;
- compare and benchmark the website against other websites, organisations, industries or sectors;
- repeat measurements of the website over time;
- calculate rankings, benchmarks, trends and aggregated statistics using those measurements; and
- publish or otherwise communicate Barometer results, rankings and accessibility trends.
A website may therefore continue to be measured as part of the Funka Barometer independently of whether the person who originally submitted the URL continues to use the Service.
Submitting a URL does not give the submitter ownership of the underlying Funka measurement methodology or prevent Funka from independently measuring the same publicly accessible website.
Because the Funka Barometer measures publicly accessible websites as part of independent accessibility benchmarking and research, it is not possible to request removal of a website from the Barometer or its rankings.
Use of scan data
By submitting a URL to the Service, you grant Funka the right to process, store, analyse and use information generated through the measurement of that publicly accessible website for the operation and development of Funka’s services.
This may include using scan results and derived data for:
- producing your Accessibility Score and report;
- monthly or recurring accessibility monitoring;
- the Funka Barometer;
- benchmarking and comparative analysis;
- accessibility research and statistical analysis;
- improving Funka’s methodology, algorithms and products;
- quality assurance and testing;
- developing and evaluating automated and AI-supported functionality;
- internal research and training; and
- producing aggregated insights about digital accessibility.
Where Funka publishes benchmarks, rankings or Barometer results, the website or organisation may be identifiable where this is necessary for the purpose of meaningful public benchmarking.
Funka may also use anonymised or aggregated data without restriction for research, product development, statistical analysis and reporting.
Nothing in these Terms transfers ownership of your website or its content to Funka.
Publicly accessible websites
The Service is intended primarily to analyse information that is publicly accessible on the internet.
You must not submit a URL where you do not have the right to initiate the requested scan, or intentionally use the Service to access restricted, confidential, private or protected systems.
You must not use the Service in a way that interferes with, damages or attempts to gain unauthorised access to any website, system or infrastructure.
Funka reserves the right to refuse, limit or stop scans where necessary for security, technical, legal or operational reasons.
Monthly monitoring
Websites enrolled in monitoring may be rescanned periodically, including approximately once per month.
Because websites change over time, Accessibility Scores and findings may increase or decrease between measurements.
Changes may result from modifications to the website, changes in detected accessibility issues, changes to applicable standards, or updates to Funka’s scanning technology or methodology.
Historical scores should therefore be understood as measurements made using the methodology and website state applicable at the time of each measurement.
Accessibility reports and recommendations
Reports, findings, improvement plans, AI-powered insights and recommended fixes are provided to help identify and prioritise potential accessibility improvements.
They are guidance and should be evaluated in the context of the website, its users and its technical implementation.
Applying a recommendation does not guarantee that an accessibility issue has been completely resolved or that the website complies with applicable law or standards.
Where appropriate, changes should be verified through further testing.
Accessibility Statements
The Service may provide tools for creating or drafting an Accessibility Statement.
Depending on the plan, Funka may provide a guided template or generate a draft statement based on information supplied by the customer and/or information identified through the Service.
Funka’s Accessibility Statement framework is designed with reference to relevant European accessibility requirements, including the European Accessibility Act and Web Accessibility Directive where applicable.
However, the applicability and exact legal requirements depend on the organisation, service, jurisdiction and circumstances.
The customer is responsible for reviewing the information contained in its Accessibility Statement, providing accurate information, making any necessary amendments and ensuring that the final published statement meets the legal requirements applicable to the organisation.
An automatically generated or Funka-drafted Accessibility Statement does not by itself demonstrate that the underlying website is compliant.
Badges
Eligible users may choose to display a Funka accessibility badge on their website.
Free users may receive a neutral badge. Premium users may be eligible for a Bronze, Silver or Gold badge depending on their current Funka Accessibility Score and the applicable badge thresholds.
A badge represents a measured result or participation in ongoing accessibility monitoring. It is not a certification, approval or guarantee of compliance by Funka.
Badge levels may change when a website is rescanned and its Accessibility Score changes.
Funka may update badge thresholds, criteria and designs from time to time.
Public accessibility page
Where a customer chooses to display or activate a Funka badge, the badge may link to a public Funka page containing accessibility information about the website.
Depending on the features enabled, this may include:
- the current Accessibility Score;
- badge or tier;
- accessibility findings or report information;
- Accessibility Statement;
- measurement or monitoring dates; and
- other information intended to provide transparency about the organisation’s accessibility.
By enabling a public badge or public accessibility page, you authorise Funka to make the corresponding information publicly available.
The purpose of the public page is transparency. It enables users to see the organisation’s measured accessibility status rather than treating the badge as a claim of certification or compliance.
Free and Premium services
Funka may offer both Free and Premium versions of the Service.
Features, usage limits, monitoring frequency, badge eligibility, AI functionality and other functionality may differ between plans.
Funka may change the features included in Free or Premium plans from time to time. Material changes affecting an active paid subscription will be handled in accordance with the applicable subscription terms.
Prices, billing periods and applicable taxes for Premium services will be shown before purchase.
Pricing and billing
Premium membership is charged at €49 per month, including VAT.
Prices are stated in euro (EUR) and billed monthly in advance. The subscription renews automatically each month until cancelled.
Any additional usage add-ons purchased inside your account are charged in accordance with the prices shown at the time of purchase.
Cancellation and what happens to your badge
You may cancel a Premium membership at any time. Cancellation takes effect at the end of the current billing period, and no further payments will be taken after that.
Premium features, monitoring and badges remain available until the end of the paid period.
Badges and any associated public accessibility page are removed at the end of the billing period following cancellation. After that point, the badge will no longer display or link to a public score.
Data retention
Account and personal data is deleted within 90 days of account deletion.
Identifiable scan and report data is retained for up to 12 months.
Anonymised or aggregated scan data may be retained for a longer period for benchmarking, research and service improvement.
Support
Customer service aims to respond to support enquiries within 24–48 hours.
AI-generated and automated content
Certain Premium features may use artificial intelligence or other automated systems to generate explanations, recommendations, prioritisation, suggested fixes or draft content.
These outputs are intended to assist users and may contain errors or may not account for the full context of a website.
AI-generated recommendations should therefore be reviewed before implementation and should not be treated as legal advice or a substitute for professional accessibility judgement where such judgement is required.
Customer responsibilities
You are responsible for:
- providing accurate information to Funka;
- reviewing reports, recommendations and generated content before relying on them;
- determining which accessibility laws and standards apply to your organisation;
- implementing and testing changes to your website;
- maintaining the accuracy of information you publish through the Service; and
- ensuring your website remains accessible and legally compliant.
The Service is intended to support accessibility work, not replace the organisation’s responsibility for it.
Intellectual property
Funka retains all rights in the Service and its underlying technology, including its scoring methodology, measurement models, software, algorithms, reports, templates, designs, benchmarking methodology and related intellectual property.
Customers retain ownership of their websites, trademarks, content and information supplied to Funka.
You may use reports, statements, badges and other outputs provided to you for their intended purpose, subject to these Terms and any plan-specific restrictions.
You may not reverse engineer, reproduce, resell or commercially exploit Funka’s methodology, scoring system or underlying technology without Funka’s written permission.
Availability and changes to the Service
Funka aims to provide a reliable Service but does not guarantee uninterrupted or error-free availability.
Scans may occasionally fail or produce incomplete results because of website configuration, security measures, technical limitations, third-party systems or other circumstances outside Funka’s control.
Funka may modify, improve, replace or discontinue parts of the Service where reasonably necessary.
Limitation of liability
To the maximum extent permitted by applicable law, Funka is not liable for decisions made solely in reliance on an automated Accessibility Score, report, recommendation, badge or other output from the Service.
The Service does not guarantee compliance with accessibility legislation or protection from regulatory action, complaints, claims, penalties or other consequences.
Funka accepts no responsibility for fines, penalties, claims, complaints, legal proceedings, losses or damages arising solely from reliance on an indicative Score, automated report, badge or generated recommendation where further professional or legal assessment was reasonably required.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Privacy and personal data
Where Funka processes personal data in connection with accounts, subscriptions, communications or use of the Service, that processing is governed by Funka’s Privacy Policy and applicable data protection law.
Website accessibility measurements are generally based on publicly accessible website information. Where scan data contains personal data, Funka will process that data in accordance with applicable data protection requirements.

Suspension and misuse
Funka may suspend or restrict access to the Service where we reasonably believe it is being used unlawfully, abusively, fraudulently, in breach of these Terms or in a way that threatens the security or operation of the Service or third-party systems.
Changes to these Terms
Funka may update these Terms to reflect changes to the Service, applicable law, accessibility standards or our business practices.
The latest version will be published on this page together with the date it was last updated.
Where required, users will be notified of material changes.
Governing law
These Terms are governed by the laws of Sweden, without prejudice to any mandatory rights that apply under applicable law.
Any dispute relating to these Terms or the Service shall be subject to the jurisdiction of the competent Swedish courts, unless mandatory law requires otherwise.
Score disclaimer
The Funka Accessibility Score is indicative.
Automated testing can detect only a portion of accessibility and usability barriers. Some requirements require human judgement, manual testing, assistive technology testing or testing with users with disabilities.
A high score does not guarantee accessibility or legal compliance, and a low score does not necessarily mean that a website is inaccessible or non-compliant.
The Score, report and badge are not legal advice, certification or proof of compliance with the European Accessibility Act, Web Accessibility Directive, EN 301 549, WCAG, ADA or other applicable legislation or standards.
For a comprehensive assessment, Funka recommends complementing automated measurement with an appropriate manual expert accessibility audit.
